These Terms & Conditions (“Terms”) govern your use of Well Given (the “Service”), operated by Veianya Hansen (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

Our Service

Well Given is a gift recommendation and list-management tool. The free version of the Service provides curated gift suggestions based on your answers to a short questionnaire. The premium version adds saved gift lists and a curated holiday hot list.

Acceptance of terms

By creating an account, making a purchase, or otherwise using the Service, you confirm that you are at least 18 years old or have the consent of a parent or guardian, and that you have the authority to agree to these Terms. If you do not agree, please do not use the Service.

Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

Acceptable use

You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:

• Using the Service for any unlawful purpose.
• Engaging in fraud, spam, or deceptive practices.
• Infringing intellectual property rights.
• Interfering with the security or integrity of the Service, including malware, probing, or scraping.
• Attempting to circumvent access controls or technical limits.

Intellectual property

All content, software, branding, and materials provided through the Service are owned by Veianya Hansen or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial purposes, subject to these Terms.

Payments

Premium access is purchased through Paddle, our online reseller and Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. By completing a purchase, you agree to those terms.

Service level

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. We may modify, suspend, or discontinue features at any time.

Termination and suspension

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately.

Disclaimer of warranties

The Service is provided “as is” without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that gift recommendations will suit every recipient or occasion.

Limitation of liability

To the fullest extent permitted by law, Veianya Hansen will not be liable for indirect, incidental, consequential, or special damages arising out of or related to your use of the Service. Our aggregate liability will be limited to the amount you paid for premium access in the twelve months preceding the claim.

Governing law

These Terms are governed by the laws of the jurisdiction where Veianya Hansen is established, without regard to conflict-of-law principles.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the revised Terms.
